Simplified Layoff

Access: It can be requested by employers whose activities or establishments are required to be closed by legal or administrative determination and for the period of such closure (December 25, 2021 - January 9, 2022). Effect on employment contracts and calculation of compensation: The employer may suspend the employment contracts of workers affected by the closure, and the calculation of compensation is made under the general terms (2/3 of the normal gross remuneration, increased until it ensures the total remuneration within the minimum and maximum limits).

Contributory regime: The employer who requests the support benefits from total exemption from contributions regarding the compensation for salary, but only for the number of days in which the entity requested the support. On days when the employer does not benefit from the support, no contribution exemption applies. Sequence with the normalization incentive and progressive recovery support: Access to the simplified layoff is not affected by the fact that the employer has previously benefited from the IEFP normalization incentive in both modalities (1 RMMG or 2 RMMG) or from the progressive recovery support.

Remuneration Statement: As for the DRI remuneration statement, during the month in which the simplified layoff applies, 2 remuneration statements must be submitted: one at 11%, for the period and workers covered by the simplified layoff, and another, at the normal rate (34.75%), for the days not covered by the simplified layoff, and the sum of days in the DRI must be 30.

Application deadline: The December 2021 application can be made until the end of January 2022 and the January 2022 application can be made until the end of February 2022. Cumulation with family support: The entities that have employees under suspension of their
suspension of employment contracts under the simplified layoff, and whose employees request family support, cannot process both supports; if the employee requests family support, the employer is not entitled to compensation for the period.
