The Family Restructuring Leave and Allowance was created in 2020 to support victims of domestic violence who have been granted such status, and who are forced to leave their residence due to that crime, as provided for in Decree Law No. 101/2021.
The Family Restructuring Allowance is granted by Social Security and lasts for a maximum of 10 days, and covers employees, self-employed workers, members of statutory bodies. It also covers victims with no employment relationship or contract and who are not covered by the Social Security system. In the case of workers covered by the convergent social protection system, the responsibility for payment lies with the public employer.
In the case of employees and civil servants, the allowance is granted for the days of leave (subject to the above limit) and corresponds to the employee's daily pay. Other workers who request this allowance receive the amount proportional to the days of leave, calculated on the value of the Social Support Index (in 2021: 438.81 euros; in 2022: 443.2 euros).
